I have them on my site. What are these? When you click on one of my affiliate links and decide to make a purchase on that site then I get a small percentage of that sale or a preset dollar amount. It’s tantamount to a referral fee basically and costs you absolutely nothing extra. You are under NO OBLIGATION to buy anything I recommend. I simply like and trust the products or services I mention and if you are going to buy them anyway why not kick me down a couple bucks? Or if you want to buy what I recommend but absolutely do not want to kick me down a couple bucks (how rude! lol) then simply go to that site but just don’t use my link. Easy peasy.

Child Theme

Usage & Limitations

Premium child themes created by A Girl and Her Mac can be used for web development purposes on an unlimited number of sites.

They CANNOT be redistributed in their original form (or reasonably true to the original form) for free or for profit by anyone other than Leslie Bernal and A Girl and Her Mac.

For instance you cannot purchase a copy of any of my child themes and then reupload them to your website/store/etsy/web app/anywhere on or off the interwebs to display as a finished product or template you are selling.

WordPress Products & Services

Form Styling

Forms must already be built, my styling services only cover design. Admin-level access is required for me to add CSS to style your forms but you can (and should) delete my user profile once I’ve finished. My CSS will be added typically in the WordPress customizer, your theme’s custom CSS area, or your child stylesheet. If you have a preference let me know, otherwise I will put it where I think is best. In some instances I may need to add a class or id to the forms, if I do I will let you know beforehand.

You are primarily purchasing my skill and creativity, meaning you can most definitely give me links to examples of forms you like (optional) but by purchasing my services you acknowledge that the final result will be what I deem to be the best design choices to match your site. I typically do not replicate other forms exactly because I believe uniqueness is key to good branding. 

Purchasing any of my form styling products does not mean I am eternally responsible for styling your forms. I style them once and that is it. If you edit my CSS and the design gets messed up I am not responsible for fixing it (I will keep a record of the CSS code I add to your site). 

I am also not responsible for third-party plugin updates or plugin conflicts. If the contact form plugin you use has an update and the form looks weird after updating you should definitely let me know, but I do not guarantee that I will edit my original CSS for free. I rarely see issues after plugin updates, but if something changes after a plugin update and it only requires what I deem to be a quick fix (usually the case) I do not mind fixing it for free.

I do not offer refunds for any of my services or products, please read all details on the product page before purchasing. I do not begin until you’ve paid and I’ve received login access.

Print-on-Demand Service

I’m using Printful Print-on-Demand (POD) service for all physical merchandise being sold on my site. I’m doing this because I really don’t know anything about screenprinting and I don’t want to handle inventory or shipping, so I went with Printful based on reviews from friends and colleagues as well as all the sample products I’ve tried myself. Your orders are printed, fulfilled, and shipped by Printful on behalf of my company, A Girl and Her Mac, and not by me personally.

Returns / Refunds

All returns and refunds are handled through Printful, as I don’t hold any merchandise myself, but even still I’d appreciate if you got in touch with me to let me know if any garment is not to your liking or if you are unhappy with your purchase for any reason. Privacy Policy

Protecting your private information is our priority. This Statement of Privacy applies to agirlandhermac.design and A Girl and Her Mac and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to A Girl and Her Mac include agirlandhermac.design and AGAHM. The AGAHM website is a ecommerce site. By using the AGAHM website, you consent to the data practices described in this statement.

Collection of Your Personal Information

AGAHM may collect personally identifiable information, such as your:

Information about your computer hardware and software may be automatically collected by AGAHM. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service and to provide general statistics regarding use of the AGAHM website (I basically use it to check my Google Analytics stuff).

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through AGAHM’s blog comment system, this information may be collected and used by others. In other words do not disclose any sensitive information in a comment on one of my tutorials. This is the internet, there are a bunch of crazies out there!

AGAHM encourages you to review the privacy statements of websites you choose to link to from AGAHM so that you can understand how those websites collect, use and share your information. AGAHM is not responsible for the privacy statements or other content on websites outside of the AGAHM website.

Use of Your Personal Information

AGAHM collects and uses your personal information to operate its website(s) and deliver the services you have purchased (i.e. premium child themes).

AGAHM may use your personally identifiable information to inform you of other products or services available from AGAHM if you have subscribed to a AGAHM list.

AGAHM does not sell, rent or lease its customer lists to third parties. Like ever.

AGAHM will not share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. Like ever.

AGAHM may keep track of the websites and pages our users visit within AGAHM, in order to determine what AGAHM services are the most popular. This data is used to deliver customized content (again, Google Analytics stuff).

AGAHM will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on AGAHM or the site; (b) protect and defend the rights or property of AGAHM; and, (c) act under exigent circumstances to protect the personal safety of users of AGAHM, or the public.

Security of Your Personal Information

AGAHM secures your personal information from unauthorized access, use, or disclosure. AGAHM uses the following methods for this purpose: When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. IF YOU BUY SOMETHING THROUGH MY SITE YOU WILL ACTUALLY GIVE YOUR CREDIT CARD INFORMATION TO STRIPE, SO YOUR INFORMATION IS PRIVY TO THEIR SECURITY PRACTICES. THIS IS A GOOD THING.

Children Under Thirteen

AGAHM does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

The agirlandhermac.design website (the “Site”) is comprised of various web pages operated by A Girl and Her Mac (“AGAHM”). agirlandhermac.design is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of agirlandhermac.design constitutes your agreement to all such Terms. This website and it’s content are controlled, operated and administered by Leslie Bernal from my couch within the USA. If you access my website from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the AGAHM content accessed through agirlandhermac.design in any country or in any manner prohibited by any applicable laws, restrictions or regulations. ALSO DO NOT STEAL MY SHIT.

Indemnification

You agree to indemnify, defend and hold harmless AGAHM, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. AGAHM reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with AGAHM in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrators award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Employer agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

AGAHM reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and AGAHM as a result of this agreement or use of the Site. AGAHM’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of AGAHM’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by AGAHM with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and AGAHM with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and AGAHM with respect to the Site. Changes to Terms

A Girl and Her Mac reserves the right, in its sole discretion, to change the Terms under which agirlandhermac.design is offered. The most current version of the Terms will supersede all previous versions. A Girl and Her Mac encourages you to periodically review the Terms to stay informed of our updates.
